Constuctive dismissal is alive and well, this actually means you are being emotionally and psychologically “blackmailed” and forced to leave your job because it becomes intolerable.


This aspect of the law deals with labour relations affecting the basic, minimum requirements for employers and employees.

Marriage In Community of Property Agreements

If you do not sign an antenuptial contract before marriage, you are automatically married in community of property in terms of South African law.

When signing an antenuptial contract, it must be in front of an attorney (who is also a notary). The signed contract is lodged for registration in the Deeds Registries Office.

Before signing an ‘out of community of property’ contract, a couple must exclude any assets that they don’t want forming part of the joint estate. A couple can be married ‘out of community of property’ with accrual system, or without accrual.

Cohabitation Agreements

A cohabitation agreement is a form of legal agreement between a couple who choose to live together - whether they are heterosexual or of the same sex.

Law for Women strongly advises couples to sign a cohabitation agreement in order to protect themselves from unnecessary cost and litigation if their relationship terminates. The agreement, much like a prenuptial agreement, allows the individuals to determine who will keep specific assets and what will happen to assets purchased jointly if they separate. This agreement is binding to both partners.

Whether you're a heterosexual couple or a same sex couple, a cohabitation contract clarifies financial commitments and sets out who pays what, and how responsibilities in running the home are shared.
